For those who received a residence permit for a startup project and don’t work on it
For digital nomads who are tired of paying high taxes every year
What is a modification of a residence permit for an individual entrepreneur?

Modification is the process of switching from one type of residence permit to another. You can apply after 1 year of residence in Spain under your previous program.

Residence permit for individual entrepreneurs allows you to run an existing business or open your own business in Spain as self-employed persons. The activity can be anything: from an online profession to a nail master. The main thing is to register an individual entrepreneurship, prove your work experience and write a convincing business plan.

The business plan must explain how the activity will have a positive impact on the Spanish economy and generate income. You must also show a bank statement with the availability of funds to start a business (from € 16,000).

Advantages of a residence permit for individual entrepreneurs

Reduced tax burden

An individual entrepreneur in Spain can take into account expenses on communications, transport, equipment and even housing, reducing the taxable base.

Requirements for a business plan are more relaxed

Unlike a startup, to obtain a residence permit for an individual entrepreneur, you do not need to prove the innovativeness of the project - a well-founded idea with real clients and a forecast is enough.

Working with clients from Spain

You can cooperate with an unlimited number of customers within the country.

Extension for 4 years at once

If you previously had a residence permit with the right to work (for example, a residence permit for a startup or a residence permit for a digital nomad-sole proprietor), after conversion you will receive legal status immediately for 4 years.

If you previously had a residence permit for financially independent people or a residence permit for a nomad with the status of an employee, you will receive a residence permit for an individual entrepreneur for 1 year with the possibility of extending it for 4 years.

Frequently asked questions about Modification of the Residence Permit for Individual Entrepreneurs

If you have any questions, please, write to us!

No, to apply for a self-employed residence permit (autónomo), you must have a valid legal status in Spain (e.g., a student residence permit). A tourist visa does not grant the right to change your residence status.

Regarding other types of residence: students may apply if less than 60 days remain before their current permit expires, but no later than 90 days after its expiration. Startup and digital nomad residence holders may apply after one year of holding their permit.

If you previously held a residence permit with work authorization (e.g., startup visa or digital nomad permit as a self-employed person), your converted permit will be valid for 4 years.

If you were employed under the digital nomad permit or had a non-lucrative visa, your converted permit will initially be granted for 1 year, and for 4 years upon renewal.

The entire process (including document preparation, application submission, and waiting for a decision) can take between 3 to 6 months. Timelines depend on the workload of the immigration office and how correctly the documents are prepared.
Yes, time under the self-employed residence permit is counted. After 5 years of legal residence in Spain, you can apply for permanent residency, and after 10 years for citizenship. To renew the permit, you must reside in Spain for at least 183 days per year.
A spouse may join:
  • Simultaneously with the main applicant, if they also open a self-employed activity in Spain.
  • Through a separate business plan, if the spouse intends to start their own entrepreneurial activity.
Children can obtain a residence permit:
  • By enrolling in a school.
  • If the child has lived in Spain for at least 2 years and hasn’t been outside the country for more than 90 days during that time.
  • Through a Spanish consulate in another country with an official representative (this process takes about 2–5 months).
Key expenses include:
  • Social security contributions of around €250–300 per month.
  • Income tax, depending on your earnings.
  • Costs for document processing, translation, and legal services (typically €500–€2,000 depending on the complexity of the case).
No, the self-employed residence permit allows only freelance or entrepreneurial work. To work as an employee, you must change your type of residence permit.
Yes, but your main income and activity must be based in Spain to meet the requirements of the permit. This is important for renewal purposes.
To renew, you must submit:
  • Proof of social security payments (as an autónomo).
  • A bank statement showing financial stability.
  • Income and expense reports for the last two quarters.
If rejected, you can file an appeal within one month from the date of notification. It is advisable to consult with a lawyer to prepare a strong appeal. Another option is to revise your documents and submit a new application.
Yes, provided you meet the requirements of the new residence type. You’ll need to file the appropriate application and submit supporting documents.
